The complete terms governing your use of Throne Host services. Please read carefully.

1. Service Agreement

By accessing or using Throne Host services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms constitute a legally binding agreement between you and Throne Host. We reserve the right to modify these terms at any time with 30 days notice. Continued use after changes constitutes acceptance.

Our services include game server hosting, web hosting, VPS hosting, dedicated servers, and related technical support services.

2. Payment Terms & Billing

Payment Schedule: Services are billed monthly in advance. Payment is due on the billing date specified in your account.

Payment Methods: We accept major credit cards, PayPal, and bank transfers. All payments must be in GBP.

Late Payments: Accounts with payments overdue by 7 days may be suspended. Services will be terminated after 14 days of non-payment.

Price Changes: We reserve the right to change pricing with 30 days written notice. Existing customers will be grandfathered for 6 months.

Taxes: All prices are exclusive of applicable taxes, which will be added to your invoice as required by law.

Payment Processing: All payments are processed securely through third-party payment processors. We do not store credit card information on our servers.

Chargebacks: Unauthorized chargebacks may result in immediate service suspension and account termination. A £25 chargeback fee will be applied to your account.

Currency: All prices are quoted in British Pounds (GBP). Currency conversion fees may apply for international payments.

3. Refund Policy

7-Day Money Back Guarantee: New customers can request a full refund within 7 days of initial service activation.

Pro-rated Refunds: Refunds for service cancellations are pro-rated based on unused service time, minus setup fees.

No Refund Situations: Refunds are not available for policy violations, resource abuse, or services terminated for cause.

Processing Time: Approved refunds will be processed within 5-10 business days to the original payment method.

Refund Exclusions: The following are not eligible for refunds: domain registrations, SSL certificates, setup fees, third-party licenses, services used for more than 30 days, and promotional/discounted services.

Refund Process: Refund requests must be submitted through our support ticket system with valid justification. Refunds are at our sole discretion and subject to verification.

Partial Refunds: We may offer partial refunds for service downgrades or early termination based on usage and circumstances.

4. Acceptable Use Policy

Permitted Uses:

  • Hosting legitimate websites, applications, and game servers
  • Running authorized software within resource limits
  • Storing and processing lawful content and data
  • Educational and research activities
  • Commercial activities that comply with applicable laws

Resource Usage: You must use resources responsibly and within allocated limits. Excessive usage that impacts other users may result in service limitations.

5. Prohibited Activities

The following activities are strictly prohibited and may result in immediate service termination:

  • Hosting or distributing illegal content, malware, or viruses
  • Sending spam, phishing emails, or unsolicited communications
  • Cryptocurrency mining without explicit written permission
  • DDoS attacks, port scanning, or network intrusion attempts
  • Hosting adult content, gambling sites, or illegal marketplaces
  • Copyright infringement or intellectual property violations
  • Proxy services, VPN services, or anonymization tools
  • Resource abuse or attempts to circumvent usage limits
  • Reselling services without authorized reseller agreement

6. Service Level Agreement (SLA)

Uptime Guarantee: We guarantee 99.9% uptime for all hosting services, measured monthly.

SLA Credits:

  • 99.0% - 99.8% uptime: 10% service credit
  • 95.0% - 98.9% uptime: 25% service credit
  • Below 95.0% uptime: 50% service credit

Exclusions: SLA does not cover downtime due to scheduled maintenance, customer actions, force majeure, or third-party service failures.

Support Response Times:

  • Critical issues: 1 hour response
  • High priority: 4 hour response
  • Normal priority: 24 hour response

7. Data Protection & Privacy

Data Security: We implement industry-standard security measures to protect your data, including encryption, firewalls, and access controls.

Backups: We perform automated daily backups, but you remain responsible for maintaining your own backups of critical data.

Data Retention: Your data will be retained for 30 days after service termination, after which it will be permanently deleted.

Privacy: We will not access your data except as necessary for technical support, legal compliance, or security purposes.

GDPR Compliance: We comply with GDPR and other applicable data protection regulations.

8. Account Management & Termination

Account Security: You are responsible for maintaining the security of your account credentials and all activities under your account.

Account Information: You must provide accurate and current information and promptly update any changes.

Suspension: We may suspend accounts for policy violations, non-payment, or security concerns with 24 hours notice when possible.

Termination by Customer: You may terminate services at any time by providing 30 days written notice. Termination is effective at the end of your current billing period.

Termination by Throne Host: We may terminate services immediately for material breach of these terms, illegal activities, or non-payment. For non-material breaches, we will provide 30 days notice and opportunity to cure.

Effect of Termination: Upon termination, your access to services will cease immediately. Data will be retained for 30 days for retrieval, after which it will be permanently deleted. Outstanding balances remain due.

Survival: Sections relating to payment obligations, intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

Data Retrieval: You have 30 days post-termination to retrieve your data. After this period, all data will be permanently deleted and cannot be recovered.

9. Indemnification

Customer Indemnification: You agree to indemnify, defend, and hold harmless Throne Host, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of our services or violation of these terms
  • Your content, data, or applications hosted on our services
  • Infringement of intellectual property rights by your content
  • Violation of applicable laws or regulations
  • Breach of third-party agreements or rights
  • Negligent or wrongful conduct by you or your users

Defense Obligations: Throne Host will promptly notify you of any claim subject to indemnification. You will assume control of the defense and settlement, provided you do not admit liability on our behalf without consent.

Cooperation: We will reasonably cooperate in the defense of any indemnified claim at your expense.

Limitation: Your indemnification obligations are limited to claims directly resulting from your actions or omissions, and do not extend to our negligence or willful misconduct.

10. Limitation of Liability

Service Limitations: Our services are provided "as is" without warranties of any kind, express or implied.

Liability Cap: Our total liability for any claims shall not exceed the amount paid by you for services in the 12 months preceding the claim.

Excluded Damages: We shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.

Third-Party Services: We are not responsible for third-party services, software, or content accessed through our platform.

11. Intellectual Property

Your Content: You retain ownership of content you upload or create using our services.

Our Property: Throne Host retains all rights to our software, infrastructure, and proprietary technologies.

DMCA Compliance: We respond to valid DMCA takedown notices and may terminate accounts of repeat infringers.

License Grant: You grant us a limited license to host, store, and transmit your content as necessary to provide services.

12. Governing Law, Jurisdiction & Dispute Resolution

Governing Law: These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Jurisdiction and Venue: You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms or their subject matter or formation (including non-contractual disputes or claims).

Dispute Resolution Process:

  1. Direct Negotiation: Parties must first attempt to resolve disputes through good faith direct negotiation for 30 days.
  2. Mediation: If negotiation fails, disputes shall be submitted to mediation under the Centre for Effective Dispute Resolution (CEDR) rules.
  3. Litigation: Only after mediation may parties pursue litigation in the courts of England and Wales.

Class Action Waiver: You agree to resolve disputes individually and expressly waive any right to bring or participate in class action lawsuits, collective actions, or representative proceedings.

Limitation Period: Any claim must be brought within one (1) year of the date the cause of action arose, or it shall be forever barred.

Injunctive Relief: Nothing herein prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

Costs and Fees: The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs from the non-prevailing party.

13. Miscellaneous Provisions

Entire Agreement: These terms constitute the entire agreement between parties and supersede all prior agreements, understandings, and communications.

Severability: If any provision is found unenforceable, the remainder shall remain in full force and effect.

Waiver: No waiver of any term shall be deemed a continuing waiver or waiver of any other term.

Assignment: You may not assign these terms without our written consent. We may assign our rights and obligations without restriction.

Force Majeure: Neither party shall be liable for delays or failures due to acts of God, war, terrorism, government actions, natural disasters, or other circumstances beyond reasonable control.

Notices: All notices must be in writing and sent to the addresses specified in your account or our contact information.

Third-Party Beneficiaries: These terms do not create any third-party beneficiary rights.
